WELCOME TO HOLDING PATTERN

1. Your Agreement
Holding Pattern cares deeply about online privacy. Holding Pattern provides its services from its website http://holdingpattern.com (the ‘Site’) to you subject to the terms and conditions, appropriate to you as a “Visitor” and as a “Fan” at , as an “Artist” or “Author” ator or as a “Customer” at (altogether “Users”). As a part of this, all Users must agree to the terms of Holding Pattern’ Privacy Policy as provided below (“Privacy Terms”).

Whatever your use of the Site, by your continued use, you are deemed to agree to and accept these Privacy Terms.

If you do not agree to these Privacy Terms you should not continue to use this Site.

2. Information Collection and Use by The Holding Pattern

Visitor Activity
You can browse the Site and view any of the unrestricted publicly accessible content on the Site (Site Content) without being an Artist or a Customer.

Fan Activity
Visitors may also participate in certain other activities on the Site, like interacting with the Site, the Artists, voting for songs, leaving comments, joining blogs and groups, receiving newsletters. By participating in such activities you become a Fan.

Artist and Customer Activity
Certain other activities on the Site, like uploading and downloading Site Content, posting comments, or watching restricted Site Content, require you to be registered as an Artist or as a Customer. In the Application Forms we ask for some personal information.

Usage Information
We may record information about your usage, such your IP address, profile information, aggregate user data, and browser type when you use the Site, the artists, pages and favourites you visit and the frequency and size of data transfers, as well as information you post, display or click on in the Site. If you are an Artist or a Customer, we may associate that information with your account. We may use clear GIFs in HTML-based emails sent to Users to track which emails are opened by recipients.

Site Management
Usage data is used to manage the website, track usage and improve the services provided by Holding Pattern. Any non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to Fans, Artists and/or Customers. User IP addresses are recorded for security and monitoring purposes

Content Uploaded to Site
Any personal information, content or material that Users voluntarily disclose online (on discussion boards, in messages and chat areas, within your Artist pages) becomes publicly available and can be collected and used by others.

Emails and Newsletters
We will use a User’s email address to send updates, receipts, changes to Site terms and conditions as well as news regarding the service and/or the Site. We may also use a User's email address to send newsletters. Users may choose not to receive newsletters by changing their "notification" setting to "Do not Send” in the appropriate User settings.

Competitions
From time to time, Holding Pattern or a partner may sponsor a promotion, competition or contest on the Site. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate.

Advertising
Holding Pattern may transfer personal information to certain advertising partners that Users have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.
 
3. Use of Cookies

Holding Pattern uses cookies to store preferences of anyone visiting the Site and to record session information, for purposes including ensuring that those visitors are not repeatedly offered the same advertisements and to customize newsletter, advertising, and web page content based on browser type and user profile information.

Holding Pattern does not link the information it stores in cookies to any personally identifiable information that Users submit while on the Site.

Users may be able to configure their browser to accept or reject all or some cookies, or notify them when a cookie is set, however, users must enable cookies from Holding Pattern in order to use most functions on the Site.
Please note that Holding Pattern allows 3rd party advertisers that are presenting advertisements on some of its pages to set and access their cookies on your computer. Advertisers' use of cookies is subject to their own privacy policies, not Holding Pattern Privacy Policy.

4. Links

Holding Pattern contains links to other websites. Holding Pattern is not responsible for the privacy policies and/or practices on other websites. When linking to another websites a User should read the privacy policy stated on that site. Holding Pattern privacy policy only governs information collected by Holding Pattern on the Site.

5. Third Party Advertising

Ads appearing on the Site may be delivered to Users by Holding Pattern or one of Holding Pattern’s Web advertising partners, who may set cookies to allow the ad server to recognize the User’s computer each time they send them an online advertisement. This privacy statement covers the use of cookies by Holding Pattern and does not cover the use of cookies by any advertisers.

6. Security

Fan, Artist and Customer information and material are secured by Fan, Artist or Customer-created passwords and Holding Pattern takes precautions to ensure that such information is kept private and uses reasonable measures to protect such information that is stored within its databases, and restricts access to such information to those employees who need access to perform their job functions.

Please note that Holding Pattern cannot guarantee the security of such information and that unauthorized entry or use, hardware or software failure, and other factors may compromise the security of  Fan, Artist or Customer information at any time

7. Sharing and Disclosure of Information

Except as otherwise described in this privacy statement, or with the permission of the User, Holding Pattern will not disclose personal information to any third party unless it believes that disclosure is necessary:
(a) to conform to legal requirements or to respond to a legal process or order received by Holding Pattern, whether or not a response is required by applicable law;
(b) to enforce the Holding Pattern Terms or to protect its rights; or
(c) to protect the safety of  Fans, Artists or Customers of the public and/or Users.

Holding Pattern reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Holding Pattern or substantially all of its assets to that successor in interest

8. Amending Information

Users may modify or remove any of their personal information at any time by logging into their account and accessing the appropriate edit features.

10. Changes in The Holding Pattern Privacy Policy

From time to time Holding Pattern may make changes to its privacy policy and if so, Holding Pattern will post them on the Site to make Users aware of what the changes. A User is bound by any minor changes to the policy when she or he uses the Site after those changes have been posted.

If, however, Holding Pattern is going to use Users' personally identifiable information in a manner materially different from that stated at the time of collection it will notify by posting a notice on the Site for 30 days.
